California Post-Divorce Modification Attorney

Need to make changes to a California divorce order?

Time does not stand still and neither do people's lives. The right attorney is always prepared for that next move. If circumstances have changed since your divorce was finalized, or since your child support or visitation rights went into effect, under certain circumstances, you may make application for modification of those orders.

Most support and custody / visitation arrangements are established during a period of transformation, when there is a divorce, or when the family is transitioning from one household to two. The end solution may not accurately meet either the paying or supported party's needs, or the interests of the children, in subsequent years. As your family grows or changes your divorce settlement plan should change with it. Job loss, increase in salary, illness, or the needs of the child are common reasons that necessitate a modification. Proceedings to Modify Court Order

Both temporary and final orders can potentially be modified by the Court. As a general rule, in the absence of a stipulation or agreement, a motion is required to change the order. A simple agreement between parties is not sufficient to change a Court order; it requires a judicial agreement as well.

If you are unable to make your child support payments due to a change in your circumstances or income, expenses or general station in life, such as job loss, illness or injury, we can advocate your circumstances to the Court.
