California Child Support Attorney

In California, child support obligations are set by statutory guidelines established by the state legislature. Among other things, the guidelines consider the gross income of the parties, timeshare (percentage of time spent with each parent) and adjust for tax consequences.

All sources of income are considered by the Court. The income may be in the form of cash, property, or services and can include:

  • Wages from a job
  • Tips
  • Commissions
  • Bonuses
  • Self-employment earnings
  • Unemployment benefits
  • Disability and Worker's Compensation
  • Interest
  • Dividends
  • Social Security or pensions
  • Any payments or credits due, regardless of the source, including lottery and prize winnings.

The finances of both parents are considered for a child support determination. The amount of support one parent pays may change depending on several variables. For example, mandatory retirement deductions, union dues, health insurance premiums, and children from other relationships, to name a few.

The guidelines can be tricky, especially with the self-employed parent, or savvy investor, where the income can be easily hidden. Other complications include the unemployed or under-employed parent. It is important to note that some factors (such as tax filing status, overtime wages, commissions, etc.) are arguable, and can be characterized in different ways so as to affect the amount of child support ordered.

In addition to the guidelines described above, the Court will routinely order each parent to pay one-half of work-related child care and one-half of all unreimbursed medical/dental charges. One or both parties will be ordered to enroll and maintain health insurance for the child.
